Samenwerkingsverband (WPO)

Also known as samenwerkingsverband passend onderwijs, partnership for inclusive education (primary)

What is a samenwerkingsverband under the Wet op het primair onderwijs?

The regional layer of passend onderwijs

A samenwerkingsverband is the partnership through which schools in a region organise support for pupils who need more than a regular class offers. In primary education every bevoegd gezag is affiliated with one for each of its school locations, under Article 18a(1) of the Wet op het primair onderwijs. The partnership covers all locations in its area, including special schools for clusters 3 and 4, unless a board has joined a national partnership instead.

The definition in Article 1 is a pointer, and the qualifier "tenzij het tegendeel blijkt", unless the contrary appears, means the act can use the word in a different sense where the context shows it. The substance sits in Article 18a(2): the aim is a coherent set of support provisions within and between schools, so that pupils can develop without interruption and pupils who need extra support get as suitable a place in education as possible.

For information security and privacy this matters because the partnership handles some of the most sensitive pupil data in the system: support needs, assessments and placement decisions. Those data flow between the school boards and the partnership, which raises the GDPR questions of who is controller, whether the parties are joint controllers, and which data each may receive. Kennisnet's begrippenlijst for the Normenkader IBP lists the samenwerkingsverband for that reason.

Secondary education has its own definition in the Wet voortgezet onderwijs 2020, with different wording on the special schools it includes.
