The Act and the decree use different words

The Wki itself never says incassodienstverlener. It speaks of a verrichter of aanbieder van buitengerechtelijke incassowerkzaamheden, someone who carries out or offers out-of-court collection activities. The Besluit kwaliteit incassodienstverlening introduces the shorter word in Article 1.1 and addresses most of its duties to it. The Besluit is made under the Wki (Article 13(7)), whose Article 2 limits the rules to collection done as a business, for a third party or after assignment, from a natural person who lives in the Netherlands.

What the Besluit asks of an incassodienstverlener

It gives the debtor a written description of the claim as soon as possible, with a breakdown into principal, interest, collection costs and VAT (Article 3.1). It approaches the debtor in a transparent, unambiguous, recognisable and correct way and is directly and easily reachable (Article 4.1), and it does not contact the debtor between 20:00 and 07:00, on Sundays or on public holidays (Article 4.2). It keeps a file for every instruction for at least two years after closing (Article 5.1), has a complaints procedure that confirms receipt within two working days (Article 6.1), and holds a meeting on social norms at least twice a year (Article 2.3). Registration costs €2,200 per incassodienstverlener plus €600 per bestuurder (Article 7.1).

Bailiffs and lawyers are included

The definition does not exclude gerechtsdeurwaarders or advocaten who collect out of court. Article 2.4 exempts them from the training rules in Articles 2.1 and 2.2 only, so the rest of the Besluit applies to them, enforced by the BFT and the deken (Articles 14(2) and 15(2) Wki). The Inspectie JenV names classic agencies, administration offices, debtor managers, VvE and property managers and buy now, pay later companies among the firms it supervises.
