What does "Bestuurder" mean in the Wki?
de bestuurder van een verrichter of aanbieder van buitengerechtelijke incassowerkzaamheden en degene die het beleid van een verrichter of aanbieder van buitengerechtelijke incassowerkzaamheden bepaalt of mede bepaalt

Last updated: 14 October 2026.
Two groups, one rule
The Wki definition has two halves. The first is the formal director of a collector. The second is anyone who determines or co-determines the collector's policy, whether or not that person holds the title. Both count as bestuurder for every rule below.
What the Wki asks of a bestuurder
The register records the name and first names of every bestuurder (Article 3(2)(d)), and a collector may not employ a bestuurder whose name is not in it (Article 12(2)). Adding or removing one is a change to the registration (Article 8(1)(c)), and adding one runs the same refusal tests as a new application (Article 8(2)). Each bestuurder adds €600 to the €2,200 application fee, and adding one later costs €600 (Besluit kwaliteit incassodienstverlening, Article 7.1).
The tests are personal. The Minister refuses registration when, given the antecedents of the applicant and its bestuurders, the rules in Articles 11 to 13 can reasonably be expected not to be met (Article 7(1)(a)). Registration is also refused when a bestuurder is under guardianship, bankrupt, in the debt restructuring scheme or in suspension of payments by a final judgment (Article 7(1)(b)). After registration, the same circumstances, or a bestuurder deprived of liberty after a criminal conviction or under a pre-trial detention order, suspend the collector's registration for as long as they last (Article 9(1)).
A bestuurder is not automatically an operationeel leidinggevende. The Besluit kwaliteit incassodienstverlening requires the collector to describe the tasks, powers and responsibilities of its bestuurders, operational leaders and collection staff separately (Article 5.3(2)).
Questions and answers
Does every director of a Dutch debt collection agency have to be in the Wki register?
Yes. Article 12(2) of the Wki prohibits a collector from employing a bestuurder whose name and first names are not in the register, and Article 3(2)(d) makes those names part of the registration. The Wki definition of bestuurder also covers anyone who determines or co-determines the collector's policy, so that person has to be registered too.
Does a bestuurder of a debt collector need a verklaring omtrent het gedrag?
Article 12(1) of the Wki requires a verklaring omtrent het gedrag from everyone who will deal with debtors or creditors, or lead that work. A bestuurder who does either falls under it. Separately, the Minister tests the antecedents of every bestuurder when the collector applies for registration (Article 7(1)(a)).
