Emission levels associated with emerging techniques
Also known as met technieken in opkomst geassocieerde emissieniveaus
What does "Emission levels associated with emerging techniques" mean under the IED?
The range of emission levels obtained under normal operating conditions using an emerging technique or a combination of emerging techniques, as described in BAT conclusions, expressed as an average over a given period of time, under specified reference conditions
Defined in / by
- IED (32010L0075), Article 3, point (48), as inserted by Directive (EU) 2024/1785

The emerging-technique counterpart of BAT-AELs
These levels are the emerging-technique counterpart of the BAT-AELs, added by Directive (EU) 2024/1785. The two definitions share their wording, except that an emerging technique or a combination of emerging techniques takes the place of a best available technique. Both are ranges obtained under normal operating conditions, described in BAT conclusions and expressed as an average over a given period under specified reference conditions.
BAT conclusions now cover emerging techniques and the emission levels associated with those techniques (Article 3, point (12)). Where BAT-AELs mark what current best available techniques achieve, these levels record what novel techniques achieve. Article 27b lets the competent authority grant temporary derogations from Article 15(2), (3) and (4) for testing and using emerging techniques, for a total period not exceeding 30 months.
A parallel 2024 definition, Article 3, point (49), covers environmental performance levels associated with emerging techniques.
Questions and answers
How do these levels differ from BAT-AELs?
The wording is the same, except that they describe emission levels obtained with an emerging technique or a combination of emerging techniques instead of best available techniques.
Where are these levels published?
In BAT conclusions, which since Directive (EU) 2024/1785 cover emerging techniques and the emission levels associated with them.
Regulations
Industrial Emissions Directive (IED 2.0)
The revised Industrial Emissions Directive is Directive (EU) 2024/1785. Member States had to transpose it by 1 July 2026, and none had notified full transposition by 25 September 2026. Operators need an environmental management system by 1 July 2027, and large pig and poultry farms follow from 2030. The Dutch bill is before the Eerste Kamer.
