> een verklaring omtrent het gedrag, afgegeven volgens de Wet justitiële en strafvorderlijke gegevens of, voor zover van toepassing, een met deze verklaring overeenkomend document, afgegeven door het daartoe bevoegde gezag in de staat van herkomst

Article 28 of the Wet justitiële en strafvorderlijke gegevens ([BWBR0014194](https://wetten.overheid.nl/BWBR0014194/2026-09-01/#Titeldeel2_Afdeling5_Artikel28)):

> Een verklaring omtrent het gedrag is een verklaring van Onze Minister dat uit een onderzoek met betrekking tot het gedrag van de betrokken natuurlijke persoon of rechtspersoon ingesteld, gelet op het risico voor de samenleving in verband met het doel waarvoor de afgifte is gevraagd en na afweging van het belang van betrokkene, niet is gebleken van bezwaren tegen die natuurlijke persoon of rechtspersoon.

Last updated: 14 October 2026.

## When a debt collector needs one

Article 12(1) of the Wki prohibits a collector from putting anyone to work who will deal with a debtor or creditor, or lead that contact, until that person has handed over a verklaring omtrent het gedrag. The certificate may be no older than three months at the moment it is handed over. The rule works per person and before the work starts, so it covers collection staff and the people who lead them, whether or not they are bestuurders.

The definition accepts a foreign equivalent: where applicable, a document corresponding to a VOG, issued by the competent authority in the state of origin. A collector employing staff from another country can rely on that equivalent where it applies.

## What the certificate says

Under Article 28 of the Wet justitiële en strafvorderlijke gegevens, a VOG is the Minister's statement that an inquiry into the person's conduct has shown no objections, judged against the risk to society for the purpose the certificate was requested for and after weighing the person's interest. The purpose matters: the certificate is requested for a specific role.

## What a missing certificate costs

A breach of Article 12 carries an administrative fine of up to the second category of Article 23(4) of the Wetboek van Strafrecht (Article 16(3)(b) Wki), €5,500 from 1 January 2026 ([Wetboek van Strafrecht](https://wetten.overheid.nl/BWBR0001854/2026-07-01/0/Boek1/Titel2/Artikel23)). A serious breach of Articles 11 to 13 obliges the Minister to strike the registration off (Article 17). The one-year transition in Article 28(1) covered the registration duty, the naming rules and the director rule in Article 12(2); it did not list Article 12(1).

> **What we could not establish**
>
> The Wki says what the certificate is and when it must be handed over. It does not say which conduct is weighed when a VOG is requested for collection work; Article 28 of the Wet justitiële en strafvorderlijke gegevens leaves that to the Minister's assessment of the risk for the purpose, and we have not reviewed that assessment practice. This entry fixes the term. It does not decide whether the term catches your institution; counsel decides that.

## Questions and answers

### How old may a verklaring omtrent het gedrag be under the Wki?

No older than three months at the moment it is handed over to the collector. Article 12(1) of the Wki prohibits a collector from putting anyone to work in contact with debtors or creditors, or in charge of that contact, until that person has handed over a VOG meeting that limit.

### Does a foreign employee of a Dutch debt collector need a Dutch VOG?

Not necessarily. The Wki definition also accepts, where applicable, a document corresponding to a verklaring omtrent het gedrag, issued by the competent authority in the employee's state of origin.
