# Deep industrial transformation

The implementation by industrial operators of emerging techniques or best available techniques involving a major change in the design or technology of all or part of an installation or the replacement of an existing installation by a new installation, which allows an extremely substantial reduction of emissions of greenhouse gases in line with the objective of climate neutrality and optimises environmental co-benefits, at least to the levels that can be achieved by techniques identified in the applicable BAT conclusions, taking into account cross-media effects

- [IED (32010L0075)](https://gencompl.ai/regulations/ied), Article 3, point (9a), as inserted by Directive (EU) 2024/1785

## What deep industrial transformation buys

Deep industrial transformation is a 2024 concept that buys time. Under Article 27e(1), where an operator plans a deep industrial transformation, the competent authority may extend the period for the installation to comply with the updated permit conditions, up to a total of eight years maximum. The permit then contains a description of the deep industrial transformation, and the operator reports annually to the competent authority on the progress.

The bar in the definition is high: a major change in design or technology, or the replacement of the installation by a new one, that allows an extremely substantial reduction of greenhouse gas emissions in line with the objective of climate neutrality. It must also reach at least the levels achievable with the techniques identified in the applicable BAT conclusions. Article 27e(2) offers a related route for closing an installation and replacing it, to be completed within eight years of publication of decisions on BAT conclusions.

Transformation plans under Article 27d, due in the environmental management system by 30 June 2030 for energy, metals, minerals, chemicals and pulp and paper activities, describe how an installation will transform over 2030 to 2050, including deep industrial transformation where relevant. [Omnibus VIII, COM(2025) 986](https://eur-lex.europa.eu/legal-content/EN/TXT/HTML/?uri=CELEX:52025PC0986), a Commission proposal of 10 December 2025, would delete Article 27d and keep the eight-year extension.

> **What we could not establish**
>
> The Directive does not quantify an extremely substantial reduction. Omnibus VIII is a proposal as at 14 October 2026, not adopted law. This entry fixes the term. It does not decide whether the term catches your institution; counsel decides that.

- [Industrial Emissions Directive (IED 2.0)](https://gencompl.ai/regulations/ied): The revised Industrial Emissions Directive is Directive (EU) 2024/1785. Member States had to transpose it by 1 July 2026, and none had notified full transposition by 25 September 2026. Operators need an environmental management system by 1 July 2027, and large pig and poultry farms follow from 2030. The Dutch bill is before the Eerste Kamer.
